This week, The Adamo Law Firm successfully obtained two dismissals on two cases set for trial just a week away.
Assault Dismissed
Through an independent investigation by our legal team we learned the alleged victim had zero intention of testifying at trial. As is the case with many assault cases, without the testimony of the alleged victim, it is extremely difficult, if not impossible for the State to prove their case beyond a reasonable doubt. The result, assault dimissed.
DWI Dismissed
Our client was stopped by an inexperienced officer in his third month of duty. He stopped our client for allegedly failing to maintain a single lane and swerving. The video, however revealed a different tale and did not reflect the officer’s sworn report. In addition the field sobriety exercises, specifically the Horizontal Gaze Nystagmus test, were not administered in accordance with the officer’s training and the National Highway Traffic & Safety Administration (NHTSA). Despite a refusal and 0.11 blood, the prosecutor was forced to dismiss the case.
