Charge: Disorderly Conduct

Punishment Range: Up to 180 days in jail.

For purposes of this arrest, Texas Penal Code 42.01 disorderly conduct states,

(a) a person commits an offense if he intentionally or knowingly:

(8) displays a firearm or other deadly weapon in a public place in a manner calculated to alarm.

Client was alleged to have displayed a gun at another vehicle during a back-and-forth road rage incident. Alarmed and upset over the incident, the complaining witness wanted 90 days in jail and the district attorney offered 1 year deferred adjudication.

With no prior criminal history it was pointed out to the district attorney that a 1 year deferred is really no different than a conviction because under Texas law, albeit some conditions, both can be blocked from the public upon completion.

The offer remained 1 year deferred adjudication and the case was set for trial.

One week before trial the prosecution offered a decision making class and dismiss. Our client took it and after completion of the short class, the case will be dismissed and eligible for expunction (erasing).
